CITY OF NEW YORK v. BERETTA U.S.A. CORP.

United States District Court, E.D. New York

November 7, 2005.

CITY OF NEW YORK, Plaintiff,
v.
BERETTA U.S.A. CORP., et al., Defendants.

The opinion of the court was delivered by: JACK WEINSTEIN, Senior District Judge

ORDER

Defendants have filed a petition for writ of mandamus, served on this court on November 5, 2005, seeking the vacation of the November 28, 2005 trial date and a stay of the proceedings in this case. As a matter of comity, to avoid an undue burden on the Court of Appeals, the November 28, 2005 trial date is vacated. A stay of all further proceedings — with the exception of those related to defendants' motion to dismiss, to be heard on November 21, 2005 at 2:00 P.M. — is granted. See Corrected Order of November 2, 2005, dated November 7, 2005.

SO ORDERED.
