ORDER

This case was referred to Magistrate Judge Leslie G. Foschio, pursuant to 28 U.S.C. § 636(b)(1)(A). O n N ovem ber 27, 2007, plaintiff filed a motion to compeldiscovery.

On January 15, 2008, M agistrate Judge Foschio filed a Decision and Order, deferring final action on plaintiff's m otion. On January 28, 2008, plaintiff filed an objection to the Decision and Order.

Pursuant to 28 U .S .C . § 636(b)(1)(A ), the district court " may reconsider any pretrial matter under this [section] w here it has been show n that them agistrate's order is clearly erroneous or contrary to law ." The court has review ed defendants' objections and Magistrate Judge Scott's Decision and Order. Upon such review , the C court finds that M agistrate Judge Foschio's Decision and Order is neither clearly erroneous nor contrary to law .

Accordingly, the court affirms the Decision and Order.

SO ORDERED.
