NEW YORK SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT
November 25, 2008
THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT,
BARRON HOWELL, DEFENDANT-APPELLANT.
Judgment, Supreme Court, New York County (Edwin Torres, J.), rendered March 5, 2007, convicting defendant, after a jury trial, of criminal possession of a controlled substance in the seventh degree, and sentencing him to a term of 1 year, unanimously affirmed.
Published by New York State Law Reporting Bureau pursuant to Judiciary Law § 431.
This opinion is uncorrected and subject to revision before publication in the Official Reports.
Lippman, P.J., Gonzalez, Moskowitz, Acosta, Renwick, JJ.
The verdict was not against the weight of the evidence (see People v Danielson, 9 NY3d 342, 348-349 ). There is no basis for disturbing the jury's determinations concerning credibility. Defendant's possession of the drugs at issue could be readily inferred from the evidence.
THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
