Motion by the respondent (1) to vacate an opinion and order of this Court dated July 10, 2007 (see Matter of Taylor, 43 AD3d 196), which struck his name from the roll of attorneys and counselors-at-law and disbarred him based upon his conviction of a felony, and (2) for reinstatement as an attorney and counselor-at-law. By decision and order on motion of this Court dated February 20, 2008, the respondent's motion for reconsideration was granted, and upon reconsideration, the opinion and order dated July 10, 2007, was amended by deleting from the first and third decretal paragraphs thereof the words "effective immediately" and substituting therefor the words "effective as of September 29, 2005." The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on April 26, 1995, under the name Daivery Gerard Taylor.

DECISION & ORDER
Upon the papers submitted in support of the motion and the papers submitted in relation thereto, it is
ORDERED that the branch of the motion which is for reinstatement as an attorney and counselor-at-law is granted; and it is further,
ORDERED that the motion is otherwise denied; and it is further,
ORDERED that, effective October 7, 2008, the respondent, Daivery Taylor, admitted as Daivery Gerard Taylor, is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Daivery Gerard Taylor to the roll of attorneys and counselors-at-law.
By decision and order of this Court dated October 7, 2008 (see People v Taylor, 55 AD3d 640), a judgment, inter alia, convicting the respondent of certain felonies was reversed, on the law, and the indictment was dismissed insofar as asserted against him. Accordingly, we grant that branch of the respondent's motion which is for reinstatement as an attorney and counselor-at-law, and we reinstate the respondent as an attorney and counselor-at-law, effective October 7, 2008.
