ORDERED that the judgment is affirmed, with costs.
We affirm the judgment on the ground that the petitioner failed to exhaust its administrative remedies before commencing this proceeding (see Village Law § 7-712-a[b]; Matter of White v Incorporated Vil. of Plandome Manor, 190 AD2d 854; see also Matter of Capitol Distribs. Corp. v Jones, 2 Misc 2d 816, 817; cf. Matter of Goldberg v Incorporated Vil. of Roslyn Estates, 61 AD3d 756).
The parties' remaining contentions need not be reached in light of our determination.
