People v. Knight

Supreme Court of New York, Second Department

July 10, 2013

The People of the State of New York, respondent,
v.
Sean Knight, appellant (Ind. No. 2562/09)

Lynn W. L. Fahey, New York, N.Y. (Barry Stendig of counsel), for appellant.

Richard A. Brown, District Attorney, Kew Gardens, N.Y. (John M. Castellano and Nicoletta J. Caferri of counsel; Andrew Dykens on the brief), for respondent.

PETER B. SKELOS, J.P. CHERYL E. CHAMBERS SANDRA L. SGROI SYLVIA HINDS-RADIX, JJ.

DECISION & ORDER

Appeal by the defendant from a judgment of the Supreme Court, Queens County (Griffin, J.), rendered April 28, 2011, convicting him of manslaughter in the first degree, upon his plea of guilty, and imposing sentence.

ORDERED that the judgment is affirmed.

The defendant's valid waiver of his right to appeal precludes review of his contention that the sentence imposed was excessive (see People v Bradshaw, 18 N.Y.3d 257; People v Lopez, 6 N.Y.3d 248, 255).

SKELOS, J.P., CHAMBERS, SGROI and HINDS-RADIX, JJ., concur.
