People v. Stokes

Supreme Court of New York, Second Department

September 25, 2013

The People of the State of New York, respondent,
v.
Darnell Stokes, appellant. Ind. No. 3227-10

Robert C. Mitchell, Riverhead, N.Y. (Louis E. Mazzola of counsel), for appellant.

Thomas J. Spota, District Attorney, Riverhead, N.Y. (Anne E. Oh of counsel), for respondent.

RANDALL T. ENG, P.J. REINALDO E. RIVERA JOHN M. LEVENTHAL L. PRISCILLA HALL, JJ.

DECISION AND ORDER

Appeal by the defendant, as limited by his motion, from a sentence of the County Court, Suffolk County (Braslow, J.), imposed October 24, 2011, upon his plea of guilty, on the ground that the sentence was excessive.

ORDERED that the sentence is affirmed.

The defendant's valid waiver of his right to appeal precludes review of his contention that the sentence imposed was excessive (see People v Bradshaw, 18 N.Y.3d 257, 264-267; People v Ramos, 7 N.Y.3d 737, 738; People v Lopez, 6 N.Y.3d 248, 255; People v Stanley, 99 A.D.3d 955).

ENG, P.J., RIVERA, LEVENTHAL and HALL, JJ., concur.
