         That the Decision of the Commissioner is AFFIRMED and plaintiffs complaint is DISMISSED. Judgment in hereby entered in favor of the defendant.

         Federal Rules of Appellate Procedure Rule 4. Appeal as of Right

         (a) Appeal in a Civil Case.

         1. (1) Time for Filing a Notice of Appeal.
