          JUDGMENT IN A CIVIL CASE

         Decision by Court. This action came to hearing before the Court.

         The issues have been heard and a decision has been rendered.

         IT IS ORDERED AND ADJUDGED

         That Defendants' Motion for Sanctions is DENIED and the Motion for Summary Judgment is GRANTED, therefore the Third Amended Complaint is hereby DISMISSED WITH PREJUDICE.

         All of the above pursuant to the order of the Honorable Norman A. Mordue, dated this 9th day of November, 2017.
